Introduction – when and why?

IR35 refers to the then Inland Revenue’s 35th press release of 1999 IR35: Countering Avoidance in the Provision of Personal Services. This was incorporated into the Finance Act 2000 and became the ‘IR35 Intermediaries legislation’ that we now refer to.

The legislation was introduced to enable the UK tax system to tax ‘disguised employment’ so that tax revenue similar to that on employment was generated. Disguised employment is the process of using an intermediary to pay an individual who would be considered to be an employee if they were paid directly from the business they are working at.

IR35 is designed to recover taxes from those who might be considered to be employees, rather than contractors who are genuinely in business of their own account and working on a project basis. But the concept of ‘employment’ is not black and white and has been debated through case law long before IR35 was introduced. IR35 is therefore plagued by grey areas, uncertainties, and the subjective interpretation of decades of legal precedent.
